A lot of times, people who come to our office after an accident tell us that this is the first time that they have been involved in an accident. They don’t know what to do, or where to go. They tell us that they don’t know where to go to obtain the medical treatment that they need and whether it will be covered by insurance. Some don’t even have insurance. Some don’t even know what doctor(s) they need to see. They ask us if we can guide them and we are sincerely humbled by that request. We believe that it is our offices’ duty to take care of and guide our clients and help them find the best medical treatment that is available.

YOUR HEALTH IS YOUR WEALTH! If you have been injured in an accident, YOU seek medical attention immediately after the accident. If you do in fact seek medical treatment, make sure that you inform the doctor or attending medical professional of each and every injury, pain or ailment that you are suffering from. Often an injured person will solely focus on the most severe injury such as a fracture and neglect to inform the medical professional of other body parts and areas that may have sustained significant injury, such as a sprained or strained body part.

When someone is injured in an accident, the last thing they are thinking of is what should I do so that everything is in order when I am being deposed in a deposition or being questioned at trial 12-36 months later. However, if you do find yourself in an accident, first and foremost, the most important thing is to ensure that you are safe and that you take care of your physical wellbeing.
Depending on the type of accident your involved in, you should:
- Call the police and inform them of the happening of the accident
- Call the EMS and/or FDNY
- Seek medical attention
- Although not at fault, it may come as second nature for some to say “sorry” that the accident happened. DON’T DO THIS as that could be construed as a statement against your interest.
- Depending on the type of accident, take pictures of the scene, the condition that caused your accident and/or the vehicles involved
- Collect information from all witnesses present at the time of the accident who were either involved in the accident or witnessed any part of the incident.
- Don’t allow any employer or supervisor to force you to tell EMS or ER personnel that the accident happened in a way that is contrary to the truth.

A personal injury action generally involves two things (i) Who is at fault? Aka “Liability”; and (ii) What are the damages, the injury, the pain and suffering and the harms and losses as a result of the incident/occurrence?
Liability – Who was at fault for the accident? Who is the culpable party that caused the accident? If there’s more than one party at fault, then it becomes an apportionment of the fault, i.e. what percentage of fault is attributed to each party.
Damages – Your lawyer will need to prove your damages’, i.e. the harms and losses caused due to the accident. This includes (i) Economic Damages’; the cost of past and future medical care and the cost of any past and future lost earning’s and benefit’s and (ii) Non-Economic Damages’; basically the human suffering involved, pain and suffering, the loss and enjoyment of one’s life, the emotional impact, harm, anxiety and anguish. Each and everyone of us live different lives’, enjoy differently and suffer differently and usually this is the largest component of damages’, but it is crucial that you select an attorney that is not just familiar with the area, but an attorney skilled in extracting that information and clearly and convincingly conveying those element’s to defense attorneys’, insurance adjusters and where necessary, to a jury of your peers.
Remember, when a case goes to trial, it’s tried by a jury of lay people, everyday people who not only get to hear the law but get to listen to the human side of one’s story and one’s suffering. Those jurors get to listen attentively and judge the credibility of the witnesses, the evidence and the lawyers. Choose a lawyer that’s right for you and one that you can trust in front of a jury in your case.
